　7月10日の広島高裁での審理は、実は最高裁からの差し戻し審で、特に④の要件自体が2023年10月に最高裁大法廷で憲法違反と判断されていて、今回はこの判断を踏まえたもの。⑤については今回特に判断をしなかったので、今後に問題は残ることになったが、高裁判断では、「周囲が違和感を感じなければよい」と判断されたらしい。
